Welcome to Cineplex Entertainment’s "Preshow Monthly Giveaway" SMS contest" ("Contest").

By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below.

Sponsor: Cineplex Entertainment LP is the sponsor and administrator of this Contest ("Cineplex" or "Sponsor").

1. How to Enter:
No purchase necessary. Standard message and data rates may apply. Contest begins noon, E.T. Friday, May 28th, 2010 and ends noon E.T. Thursday, December 30th, 2010 ("Contest Period"). To enter the contest, the Entrant must text the key word shown on screen during the Cineplex Preshow Monthly Giveaway spot in the Cineplex Entertainment preshow to 66843 (MOVIE). There will be a different keyword for each Preshow Month, as defined below, for the entrant to enter to win.

Each Preshow Month will be based on the following pre-show schedule. Each Preshow Month there will be a new KEYWORD.

Cineplex Entertainment Monthly pre-show Schedule:

The entrant must generate a new text or SMS message with his or her mobile phone. After a new text or SMS message has been generated, it must be sent with the key word as shown on the screen during the ‘Preshow Monthly Giveaway’ spot to the short code, 66843 (MOVIE). This spot is seen before the featured movie at Cineplex theatres. To enter the Contest via text message/SMS, an entrant must have a mobile telephone that has a two-way text messaging capable handset and digital service feature. Standard text messaging/SMS service charges apply. Entrants must check their carrier plans for standard text messaging fees. Once your text or SMS message is received, you will be automatically entered into the Contest.

Alternate means of entering: Participants may also enter the Contest by submitting in writing the name of a film they are looking forward to seeing in 2010, on a postcard with adequate postage including their name, address and phone number (with area code) and mailing it with sufficient postage to 1303 Yonge St, Toronto, Ontario M4T 2Y9. All mail-in entries must be postmarked during the Contest Period. Entries received will be entered into the draw for the Preshow Month in which they are received. For example, if your mail-in entry is postmarked June 15th, and received July 2nd, that entry will be entered into the draw for the Preshow Month of July. Entries for the Preshow Month of December must be postmarked on or before December 30, 2010 and received no later than January 5, 2011. Sponsor is not responsible for entries delayed or lost in the mail. Be sure your name, address and phone number is complete. Mechanically reproduced entries will not be accepted. Multiple postcards mailed together in a single envelope shall be considered one entry only. Subsequent entries submitted by the same participant will be void.

Entrants are limited to one (1) entry by any method per person, for each Monthly Preshow draw. For the purpose of determining the number of mail-in entry received per day by a single person, the date of entry shall be considered the date it is received by Sponsor. Each entry is only valid for the Monthly Preshow draw for the month in which the entry was made and will not be carried over to the next Monthly Preshow draw. The odds of winning will depend on the total number of eligible entries received for each Monthly Preshow draw. A maximum of one Prize will be awarded per person.

2. Prize:
There are a total of seven (7) Cineplex Night Out movie tickets to be won during the Contest Period, one Cineplex Night Out movie ticket will be awarded for each of Preshow Month identified above. The approximate retail value of each prize is $37 CDN. Cineplex Night Out can be used at any Cineplex Entertainment theatres (Cineplex Odeon, Scotiabank, SilverCity, Colossus, Coliseum, Galaxy or Cinema City) valid towards two general admissions, 1 regular popcorn and 2 regular soft drinks. This ticket is valid for movie performances only. Admission to non-feature film presentations, IMAX, IMAX 3D, Real-D 3D and VIP Room performances are subject to a surcharge.

The Prize must be accepted as awarded without substitution and is not transferable or redeemable for cash or allowed to be sold. The Sponsors reserves the right, in its sole discretion, to substitute the Prize in whole or in part, for equal or greater value, in the event that all or any of the components of the Prize are unavailable. In the event that the winner is unable to redeem any or all of the Prize components due to reasons beyond the control of the Sponsors, their employees, representatives, agents, and all parties associated with this Contest, without limitation, no compensation or substitution prize will be provided. By accepting the Prize, the winner consents to the use and disclosure of the his/her name, likeness, address (city/province), voice, statements, submission(s) and any photographs taken of winner, in whole or in part, or as modified at the Sponsor’s sole discretion, in connection with the advertising, exhibiting, marketing, promotion and exploitation of the business of the Sponsor in any manner, in all media throughout the world at no compensation and with no further notice. The winner may be required to sign a document to that effect. There is a maximum of one Prize per person.

3. Prize Drawing:
Sponsor will conduct a random draw approximately one (1) week after the end date of each Preshow month identified above at approximately noon EDT in Toronto. The Sponsor will attempt to contact the potential Prize winner by telephone. If a selected entrant cannot be reached within two business days after the date of the draw or after 3 attempts to contact, whichever comes first, Sponsor shall have the right to choose another entrant from the remaining eligible entries. This process shall continue until the Prize has been awarded. Before being declared the winner of a Prize, the selected entrant must first correctly answer, without assistance of any kind (whether mechanical or otherwise) a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone. If the selected entrant fails to answer the question correctly, the Prize will be forfeited and an alternate potential winner will be selected. The Prize winner may be required to sign a declaration confirming understanding of, compliance with, and acceptance of the Contest rules and acceptance of the Prize as awarded and a standard release of all liability satisfactory to the Sponsor before being declared a Prize winner.

4. Eligibility:
Contest is open to legal residents of Canada who reside in the provinces of British Columbia, Alberta, Saskatchewan, Manitoba or Ontario ONLY and who are at least the age of majority as of their date of entry into the Contest. Contest is not open to employees and those domiciled with employees of the Sponsor or any parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies ("Related Parties"). Sponsor reserves the right to verify the age of potential prize winners and that such persons are not employees (or domiciled with employees) of any Related Parties. Void where prohibited.

5. General Rules:
The Sponsor shall not be liable for lost, late, incomplete, misdirected, and not received, stolen, mutilated, or illegible entries. By entering this Contest, entrants accept and agree to be bound by these rules and the decisions of the Sponsor, which are final, binding and conclusive on all matters relating to this Contest. All entries become the property of the Sponsor, none will be returned and no correspondence will be entered into except with selected entrants who will be notified by telephone. The Sponsor reserves the right to disqualify all entrants who fail to follow these official rules and regulations or who make any misrepresentation relating to the Contest, drawing and redemption of the Prize. This Contest is subject to all applicable Federal, Provincial and Municipal legislation. Entry constitutes permission to use the winner’s name, photograph, and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law. Decisions of the Sponsor are final with respect to all aspects of this Contest.

6. The Sponsor shall not be responsible for any wireless network failure during the promotion or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any mobile entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible if due to technical problems, traffic congestion on the wireless network, or any combination thereof for any damage including any injury or damage to an entrant's or any other person's mobile phone or property related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, at its sole discretion to modify, cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

7. In the event of a dispute, entries will be deemed to have been submitted by the Authorized account holder of the mobile number used to enter the Contest. "Authorized account holder" is defined as the person who is assigned a mobile number by a mobile service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning mobile numbers. If the identity of an entrant is disputed, the Authorized account holder associated with the mobile account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the Authorized account holder of the mobile number associated with the selected entry name change. The sole determinant of the time for the purposes of a valid mobile entry in this Contest will be the Contest server machine(s).

10. Privacy: At Cineplex, we are committed to respecting your desire for privacy. Any personal information that we gather will be handled in strict accordance with our privacy policies and all applicable privacy legislation. Cineplex will not sell your personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Cineplex as is disclosed herein. 11. No Liability: Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prize awarded in this Contest or the events forming part of this Contest. By participating in this Contest or accepting a Prize, all entrants release and hold harmless Sponsor and its subsidiaries, affiliates, officers, directors, employees, representatives and agencies from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of the Prize or parts thereof, and from liability to any other persons relating to or resulting from entering this Contest.
